Please read these terms carefully before engaging Peninsula Leak 'n' Locate

Welcome to Peninsula Leak 'n' Locate. We're committed to providing reliable leak detection, underground service locating, CCTV drain inspection and septic tank locating services across the Mornington Peninsula and Victoria. To help you understand what to expect when working with us, we've outlined our terms and conditions below. By engaging our services, you agree to the terms set out on this page.

1Understanding our services

Our services include leak detection (water, gas, pool and irrigation), underground service locating, CCTV drain inspection and clearing, and septic tank locating and inspection. Each of these is a specialised process that relies on electronic detection equipment, available records, site conditions, and visible surface indicators to identify the likely position, condition or source of an issue. While we use industry-standard equipment and proven techniques, underground and concealed conditions can vary and may affect results.

2Accuracy of findings, markings and reports

Any findings, markings, or locations we identify and report on — whether a leak source, an underground service, a drain defect, or a septic tank or pipe network — are approximate and represent our best interpretation of the information available at the time of inspection. Factors such as ground conditions, interference, depth, unknown or undocumented infrastructure, inaccessible areas, and changes to the site can influence accuracy. Our markings and reports should be used as a guide and not as an exact or guaranteed representation of underground assets, leak sources, or system conditions.

3Underground services & safe excavation

Not all underground services can be detected, and some infrastructure may be undocumented, abandoned, or otherwise difficult to identify. If excavation work is planned, we strongly recommend exercising caution around all marked or suspected underground services. Before using mechanical excavation equipment near marked services, their exact location should be confirmed using non-destructive methods such as hand digging or vacuum excavation.

It is the responsibility of the property owner, contractor, or excavator to ensure safe excavation practices are followed and that all relevant parties are aware of underground service locations. Peninsula Leak 'n' Locate is not responsible for damage arising from excavation undertaken by others following our inspection.

4Utility records & third-party information

Where available, we may use information supplied by utility providers, asset owners, or BYDA (Before You Dig Australia). While this information can be helpful, we cannot guarantee its accuracy or completeness, as it is provided by third parties and may not always reflect actual site conditions.

5Factors that can affect results

The accuracy of our findings can be influenced by a range of factors, including:

  • Reinforced concrete or metal structures
  • Electrical interference
  • Deeply buried or concealed services and systems
  • Non-conductive materials such as PVC
  • Congested underground or confined environments
  • Lack of tracer wires or signal access points
  • Weather and ground moisture conditions
  • Site access limitations or obstructions

Where practical, we will advise you of any significant limitations encountered during our inspection.

6Markings & site changes

Paint markings, flags, stakes, and other indicators are temporary and intended as a short-term guide only. Weather, traffic, landscaping, construction activity, and the passage of time can affect their visibility and accuracy. If excavation works are delayed, we recommend arranging a re-inspection or remarking service before work begins.

7Quotes & job scope

Where a quote is provided, it is based on the information and access available at the time. Should site conditions, scope, or access differ once work begins, we will discuss any necessary adjustments with you before proceeding. Verbal estimates given over the phone are indicative only and may vary once we attend site.

8Payment terms

Unless otherwise agreed in writing, invoices are due for payment within 7 days of the invoice date. Late payment may incur reasonable administration fees or interest in accordance with Victorian law, and we reserve the right to suspend further work or services until overdue accounts are settled.

9Cancellations & rescheduling

We understand plans can change. We ask that you provide as much notice as possible if you need to cancel or reschedule a booking. Cancellations made with less than 24 hours' notice, or a failure to provide safe and reasonable access to the property at the agreed time, may incur a call-out or rescheduling fee to cover lost time and travel.

10Liability

To the maximum extent permitted by law, Peninsula Leak 'n' Locate's liability for any loss or damage arising from our services is limited to the cost of re-supplying the service. We exclude liability for indirect or consequential loss, including loss of profits, loss of use, or damage arising from excavation, construction, or other works carried out by third parties relying on our findings.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other applicable legislation that cannot lawfully be excluded.

11Our commitment

We take pride in delivering professional, high-quality services using reasonable care, skill, and industry best practice. However, findings from leak detection, underground service locating, CCTV drain inspection and septic tank locating should always be used alongside safe work procedures and, where appropriate, independent verification.

12Governing law

These terms are governed by the laws of Victoria, Australia, and any disputes will be subject to the jurisdiction of the courts of Victoria.
